to assist the bereaved on the death of a loved one, a web-based
‘living’ memorials area where you can create
a lasting tribute in memory of individuals who have passed
away, and a ‘living stories’ arena for life
experiences. Many memorials & stories are created by
VacantChair staff, and others are created by users of VacantChair
who are not affiliated or related in any way to VacantChair.co.uk.
Some of VacantChair.co.uk services will be free of charge,
whilst others may incur a cost to the User or have other
requirements that will be clearly stated.
Acceptance of Our Terms & Conditions:
VacantChair.co.uk is provided to you (the User) under
the terms and conditions detailed below and comprises the
entire agreement between User and VacantChair.co.uk. Reference
to “use of the website” means to view website
content and/or to establish, edit & maintain a private
obituary, memorial and/or general interest story. By using
the website and/or creating an obituary, memorial or personal
story, you are indicating your agreement to the site’s
terms and conditions.
Making Necessary Changes:
VacantChair.co.uk reserves the right to modify any services
offered on the site or site features, appearance and function.
VacantChair.co.uk also reserves the right to change our
Terms of Use as and when required. and will notify all users
who have submitted their story to VacantChair.co.uk by sending
an e-mail to the address the User provided. Continued use
of the Service constitutes agreement to follow the Terms
of Use and agreement by User to abide and be bound by those
Terms of Use and Terms of Use modifications.
Protecting your privacy & Data:
All information entered into VacantChair.co.uk is considered
public by User, with the exception of the User contact information
which is considered private unless explicitly stated otherwise
by the User. We will not disclose User's e-mail contact
information to any third party and will also not monitor,
edit, or disclose the contents of this information, unless
it was required by law to do so, or in the belief that such
action is necessary to conform to the edicts of the law
or comply with legal process served on VacantChair.co.uk
or (a) protect and defend the rights or property of VacantChair.co.uk
or (b) act in order to protect the personal safety of VacantChair.co.uk
users, or the public (c) repair problems with the VacantChair.co.uk
software/service or (d) the User has significantly contravened
these Terms of Use.
The operators of the website make all reasonable efforts
to protect User information and the User’s privacy.
Still, because of the nature of electronic communication,
it is not possible to guarantee complete protection of that
information. Accordingly, the User frees the operators of
the website from any responsibility for damage or injury
whether direct or indirect, financial or other, incurred
by the user as the result of disclosure of this information,
regardless of the reason for the disclosure.
User Account Security:
Once a User creates an obituary, a memorial or story he/she
is absolutely responsible for maintaining the confidentiality
of any required password or reference number given to or
chosen by him/her. Furthermore, he/she is entirely responsible
for any and all activities occurring under his/her account.
User agrees to immediately notify VacantChair.co.uk of any
abuse/unauthorized use of User's account or any other breach
of security that becomes known to them.
Ownership of Content & Responsibility :
The User grants the website Operators the right to make
use of all of the content uploaded by him/her, including
its distribution and publication. The User acknowledges
and agrees that VacantChair.co.uk neither endorses the content
of any of the obituaries, memorials or personal stories
featured within VacantChair.co.uk nor assumes any responsibility
for said content. The Operators of the website retain the
right to remove, edit or omit content that is not in keeping
with the website’s purpose or ethos. The operators’
decision to do so cannot be taken as acceptance of any responsibility
for the content appearing on the website which was not placed
there by them.
Warranty Disclaimer:
User agrees that use of this website is entirely at User’s
risk. The service provided by VacantChair.co.uk is on an
‘as is’ & ‘as available’ basis
only. VacantChair.co.uk expressly disclaims all warranties
of any kind, whether expressed or implied, including, but
not limited to, the implied warranties of merchantability,
fitness for a particular purpose & non-infringement.
VacantChair.co.uk makes no guarantee that the service will
be uninterrupted, timely, secure, complete or free from
error; nor does it make any warranty as to the results that
may be obtained from the use of the service or as to the
accuracy or reliability of any information obtained through
the service, or that defects in the software will be corrected.
User understands & agrees that any material &/or
data downloaded or otherwise obtained through the use of
the service is done at User’s own discretion &
risk. User will be solely responsible for any damage to
User’s computer system or loss of data that results
from the download of such material or data. No advice or
information, whether oral or written, obtained by User,
from or through VacntChair.co.uk shall create any warranty
not expressly made herein.
Data & Information Maintenance & Storage:
VacantChair.co.uk assumes no responsibility for the deletion
of or failure to store information in VacantChair.co.uk
obituary/memorial/living story website. VacantChair cannot
guarantee to maintain data online absolutely, permanently
and without change. The supply of electronic information
cannot be unequivocally assured and can become influenced
by outside parties including government laws, broadband
suppliers, energy suppliers etc and is beyond the control
of the site operators. Use of this website indicates acceptance
of this fact and that VacantChair can accept no responsibility
for any such event.
User Conduct & Agreement:
The User is solely responsible for the contents of his
or her obituary/memorial or living story. User's use of
the Service is subject to all applicable local, state, national
and international laws and regulations. The User agrees
to comply with UK law regarding transmission of technical
data exported from the UK through the Service and agrees
not to use the Service for illegal purposes and not to interfere
or disrupt networks connected to the Service. The User also
agrees to comply with all regulations, policies and procedures
of any networks connected to the Service.
The User agrees absolutely not to upload, store or distribute
any content that is illegal and/or designated for carrying
out illegal activity and/or content which injures the operations
of the website and/or users of website, which is of a libellous,
harassing, inciting, insulting or defamatory nature or contains
viruses and software likely to be damaging to site or users.
This includes content of an advertising and/or commercial
nature and /or content which may infringe on or harm existing
copyrights.
The User specifically agrees not to upload, store or distribute
any content that may contradict current Defamation Laws
and/or the Privacy Protection Law and content which can
be seen as Junk-mail (spamming).
The User agrees to use the website exclusively for its
stated purpose. Not to use the Service for chain letters,
junk mail, spamming or any use of distribution lists to
any person who has not given their specific permission.
Not to transmit through the Service any unlawful, harassing,
libellous, abusive, threatening, or harmful material of
any kind, or any material that encourages conduct that could
constitute a criminal offence, give rise to civil liability
or otherwise violate any applicable local, state, national
or international law or regulation.
Not to attempt to gain unauthorized access to other computer
systems.
Not to interfere with another User's use and enjoyment
of the Service or another entity's use and enjoyment of
similar services.
Operators may, at their sole discretion, immediately terminate
Service should User's conduct fail to conform to these terms
and conditions of use.
Indemnification:
User agrees that all VacantChair.co.uk owners, parent companies,
subsidiaries, affiliates, officers and employees, shall
not be liable for any claim or demand, including any legal
fees, made by any third party due to or arising out of User's
use of the Service, the violation of this Terms of Use by
User, or the infringement by User, or other user of the
Service accessing User's computer, of any intellectual property
or other right of any person or entity.
Termination of Our Service & User’s Right
to Terminate:
Either User or VacantChair.co.uk may terminate the Service
with or without cause at any time and effective immediately.
VacantChair.co.uk shall not be liable to User or any third
party for termination of Service. If service is terminated
at any time by User or VacantChair.co.uk, due to the nature
of the service, the running and administration costs incurred,
it cannot be guaranteed that refunds or payments will be
made. Should User object to any terms and conditions or
any subsequent modifications or become dissatisfied with
the Service in any way, User's only recourse is to immediately
discontinue use of the Service. Upon termination of the
Service, User's right to use the Service and Software immediately
ceases. User shall have no right and VacantChair.co.uk will
have no obligation thereafter to deliver the user any of
the content from their memorial or life story.
Notice:
All notices to a party shall be in writing; made either
via email or conventional mail. The Operator may broadcast
notices or messages through the Service to inform User of
changes to the Terms of Use, the Service, or other matters
of importance; such broadcasts shall constitute notice to
User.
Proprietary Rights to Content:
User acknowledges that content, including but not limited
to text, software, music, sound, photographs, video, graphics
or other material contained in either sponsor advertisements
or email-distributed, commercially produced information
presented to User by the Service ("Content") by
VacantChair or its affiliates, are protected by copyrights,
trademarks, service marks, patents or other proprietary
rights and laws; therefore, User is only permitted to use
this Content as expressly authorized and may not copy, reproduce,
distribute, or create derivative works from this Content
without expressly being authorized to do so.
Laws of the Land:
The Terms of Use shall be governed by and operated in accordance
with the laws of the United Kingdom. User and VacantChair.co.uk
agree to submit to the exclusive jurisdiction of the United
Kingdom legal service. Failure by VacantChair.co.uk to exercise
or enforce any right or provision of the Terms of Use shall
not constitute a waiver of such right or provision unless
acknowledged and agreed to by VacantChair.co.uk in writing.
User and VacantChair.co.uk agree that any cause of action
must commence within six months after the cause of action
arose; otherwise, such cause of action is permanently barred.
The section titles in the Terms of Use are solely used for
the convenience of the parties involved and have no legal
or contractual significance.
